QLYQQ Terms & Conditions

1. Key Disclosures

Before using QLYQQ, please take note of the following:

QLYQQ offers paid subscriptions and may also offer free trial periods from time to time.
Subscriptions renew monthly or annually unless cancelled before the renewal date.
You may cancel at any time; cancellation takes effect at the end of the current billing cycle.
No refunds are issued for digital services once activated, except where required by the Consumer Protection Act (CPA).
Physical NFC products are refundable or replaceable only if defective.
QLYQQ profiles can be shared publicly via QR code, URL, or NFC, including with non-users.
Your personal data is processed in accordance with the Protection of Personal Information Act (POPIA).
Continued use of QLYQQ constitutes acceptance of these Terms and any future updates.

2. Definitions

QLYQQ

A digital identity and smart networking platform enabling users to create, manage, and share interactive digital profiles, optionally linked to NFC products.

User / You / Your

Any individual or legal entity accessing or using the QLYQQ platform.

Services

All digital services provided by QLYQQ, including digital profiles, booking tools, product listings, analytics, NFC card services, and web or mobile access.

Trial Period

A limited-time, free or discounted access period to specific QLYQQ features, subject to conditions.

3. Platform Use & Licence

3.1. By registering an account or using QLYQQ, you enter into a legally binding agreement with QLYQQ.

3.2. You must be 18 years or older, or have valid parental or guardian consent.

3.3. You agree not to use QLYQQ for:

Unlawful activities
Fraud, impersonation, or misrepresentation
Harassment, abuse, or defamatory conduct

3.4. You may not copy, modify, reverse-engineer, resell, or exploit any part of the platform without written permission.

4. Trial Periods

4.1. QLYQQ may offer free or promotional trial periods at its discretion.

4.2. Trial periods:

Are limited to one per user or business, unless stated otherwise
Automatically convert to a paid subscription unless cancelled before the trial ends
May require valid payment details upfront

4.3. Abuse of trial periods (including multiple accounts or false information) may result in suspension or termination without notice.

4.4. Features available during trials may differ from paid plans.

5. Subscriptions, Pricing & Refunds

5.1. Subscription pricing is displayed on the QLYQQ website or app and may change with notice.

5.2. Billing occurs automatically on the renewal date.

5.3. Refunds

Digital services are non-refundable once activated.
Defective physical NFC products may be replaced or refunded within 7 days, in line with the CPA.

5.4. You may cancel via your dashboard or by contacting support@qlyqq.com.

6. Data Protection & POPIA Compliance

6.1. QLYQQ processes personal information lawfully and transparently in accordance with POPIA (Act No. 4 of 2013).

6.2. Personal data is processed only for legitimate business purposes, including:

Account creation and management
Service delivery
Customer support
Analytics and platform improvement
Legal and regulatory compliance

6.3. Users may request access, correction, restriction, or deletion of their data by contacting privacy@qlyqq.com.

7. Features & Availability

7.1. QLYQQ features include:

Digital profiles
QR, URL, and NFC sharing
Bookings and calendars
Product and service listings
Analytics and engagement insights

7.2. While we aim for high availability, downtime may occur due to maintenance or technical issues.

8. Security

8.1. We use industry-standard safeguards including encryption, access controls, and monitoring.

8.2. You are responsible for maintaining the confidentiality of your login credentials.

8.3. Suspected security incidents must be reported immediately to support@qlyqq.com.

9. Physical Products (NFC Cards)

9.1. NFC cards are manufactured and shipped according to your order details.

9.2. Delivery timelines are estimates; courier delays are outside QLYQQ’s control.

9.3. Defective products must be reported within 7 days of delivery.

10. Limitation of Liability

To the extent permitted by South African law:

QLYQQ is not liable for indirect, incidental, or consequential damages.
Total liability is limited to the most recent subscription fee paid or replacement of defective goods.

11. Termination

11.1. You may terminate your account at any time.

11.2. QLYQQ may suspend or terminate access if:

These Terms are breached
Fraud or abuse is detected
Legal or regulatory requirements demand it

12. Governing Law

This Agreement is governed by the laws of the Republic of South Africa, including:

Consumer Protection Act
Electronic Communications and Transactions Act
Protection of Personal Information Act
